Privacy policy for employees
Information on the processing of personal data as part of the application procedure for prospective employees at the Fachhochschule des Mittelstands (FHM)
 

With this data protection information, FHM fulfills its duty to provide information in accordance with Articles 12, 13 of the General Data Protection Regulation (GDPR) for the processing of personal data mentioned above. With regard to the other terms used, “personal data”, “processing”, “controller”, “third party”, etc., reference is made to the definitions in Article 4 of the GDPR.

3. purpose of the processing

Decision on the establishment of an employment relationship.

As part of your application (job advertisement or unsolicited application) for a position at the FHM, you submit personal data in the form of your application documents, which are processed at the FHM. This is done for the purpose of carrying out the application procedure.
 

4. Legal basis for data processing

The selection of suitable applicants in the application process takes place prior to the conclusion of an employment contract with the applicant and is therefore in the pre-contractual area. The transmission of personal data is based on the legal basis of Art. 6 para. 1 lit. b GDPR in conjunction with § Section 26 (1) BDSG-new (initiation of an employment relationship) and Art. 88 GDPR. The same applies to a request that is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. If you provide us with special categories of personal data in the application process, we process these on the legal basis of Art. 9 para. 2 lit. b GDPR in conjunction with Art. 88 para. 1 GDPR. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 para. 1 lit. f GDPR) or if you voluntarily provide us with personal data, Art. 6 para. 1 lit. a GDPR applies. If, in the event of a negative decision, you have given your consent to further data storage for any subsequent job offers, the legal basis for further data storage is your consent in accordance with Art. 6 para. 1 lit. a GDPR. This consent can be withdrawn at any time in the future - even without giving reasons.
 

The technical implementation by the provider on the website for data processing is carried out on the legal basis of Art. 6 para. 1 lit. f GDPR.
 

The conditions for the processing of personal data are considered secure by the technical and organizational measures taken at FHM within the meaning of the GDPR.
 

5. Duration of storage and information on data protection

Personal data will only be stored for as long as is necessary for the prescribed purpose. The controller will not publish personal data or pass it on to third parties if it is not required for the purpose of processing. After termination of the purpose, your data will be deleted by FHM and the processors after expiry of the purpose (Art. 5 para. 1 lit. e GDPR). If your application is rejected, your application documents will be stored for up to six months after this decision before they are deleted.
 

This storage period is due, among other things, to the deadlines of the General Equal Treatment Act, during which rejected applicants may be able to assert claims. The authorization to store data for this period is based on § 18 para. 7 DSG NRW. You will not be notified of the deletion of your data.
 

Where is my personal data processed?

The processing of personal data takes place at FHM on servers in Germany.
 

Processed data

The following personal data is processed and stored in advance by the applicant
 

  • Contact details: Title, first name, surname, address
     
  • Communication data: Telephone number, e-mail
     
  • Attachments: Documents (cover letter, CV, certificates), qualifications and experience
     
  • In addition, you can provide further information voluntarily (e.g. in the CV or cover letter): current position, marital status, number of children, date of birth, place of birth, title, nationality, private address incl. and telephone number, (severe) disability, further education and qualification-related data (school/university degree, professional career, etc.), other application-relevant data (letters of recommendation, job references, proof of voluntary work, proof of stays abroad, etc.).
     

The following system and log data is processed to ensure the proper operation of the application portal (rectification of faults and errors, processing of security incidents, etc.):
 

  • Log data for performing and ensuring the functions on the website
     
  • Usage, device and browser information
     

6. recipient of the collected data

The recipient of your data is Fachhochschule des Mittelstands (FHM) GmbH, Ravensberger Straße 10 G, 33602 Bielefeld. Your data will only be accessible to selected FHM employees who are involved in filling vacant positions, e.g. the management, the HR management department, site management, etc. All FHM employees with access rights are obliged to maintain confidentiality about your data as part of their employment relationship. An appropriate level of data protection is ensured.
 

If a processor is commissioned by us to process personal data, this processor is contractually obliged under the data processing agreement to implement the statutory security requirements in order to guarantee the confidentiality and security of your data and to process the data only in accordance with our instructions.
 

Any printouts are forwarded to a document shredder for destruction. The data provided by you will be used exclusively for the processing of your application, which is legitimized by Art. 6 para. 1 lit. b/f GDPR.
 

7. transfer to a third country

In principle, personal data is not processed in a third country.
 

8 Rights of the data subjects

In accordance with the General Data Protection Regulation, you have the following rights vis-à-vis FHM with regard to the data concerning you. The
 

  • Right of access (Art. 15 GDPR)
     
  • Right to rectification (Art. 16 GDPR)
     
  • Right to erasure (Art. 17 GDPR)
     
  • Right to restriction of processing (blocking) (Art. 18 GDPR)
     
  • Right to data portability (Art. 20 GDPR)
     
  • Right to object to the processing (Art. 21 GDPR)
     
  • Right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR)
     

provided that these rights are not restricted by other laws in the context of data processing.
 

You can also exercise your right to object (Art. 21 GDPR) at any time without giving reasons. If you would like to exercise one of these rights, you can contact the Human Resources Management department by email at jobs@@fh-mittelstand..de at any time. You are entitled to a response within one month of receipt of the request for information.
 

9. is the provision of personal data required by law or contract or necessary for the conclusion of a contract, or is the data subject obliged to provide the personal data? What would be the consequences of not providing the data?
 

Yes, without the application documents, the application process cannot be carried out.
 

10. Automated decision-making

Since the decision on your application is not based exclusively on automated processing, no automated decision is made in individual cases within the meaning of Art. 22 GDPR.
